Terms of Service

These Terms govern your use of HTSBase (the "Service"), operated by Nexon Technologies, Inc., a Delaware corporation ("we", "us"). By creating an account or using the Service you agree to these Terms.

1. What the Service does

The Service suggests Harmonized Tariff Schedule (HTS) classifications for products you describe and estimates U.S. duties, fees and trade-agreement treatment from published government data. Suggestions are produced by software, including machine-learning models, and may be incomplete or wrong.

2. Not legal or customs advice

We are not a licensed customs broker, and the Service is not legal, tax or customs advice. Under U.S. law the importer of record must use reasonable care to classify, value and declare goods. You remain solely responsible for every classification, valuation and entry you or your broker file, and for any duties, penalties or other consequences. Verify results against the official HTSUS, CBP rulings and a licensed broker before relying on them.

3. Accounts

  • You must provide accurate information and keep your password and API keys confidential.
  • You are responsible for all activity under your account and API keys.
  • You must be at least 18 and able to enter a binding contract.

4. Plans, billing and renewal

  • Paid plans are billed in advance each month through Stripe and renew automatically until canceled.
  • You can cancel at any time from your account's billing portal; access continues to the end of the paid period.
  • Prices may change with at least 30 days' notice by email. Taxes may be added where required.
  • Daily limits and fair-use caps apply as described on the pricing page. Refunds are covered by our Refund Policy.

5. Acceptable use

You agree not to:

  • resell or redistribute the Service or its outputs as a competing database or service;
  • scrape, overload or attempt to bypass limits, authentication or security controls;
  • use the Service to evade duties, sanctions, export controls or other laws;
  • submit content you have no right to submit or that is unlawful.

6. Your content

You keep ownership of the product descriptions and files you submit. You grant us a limited license to process them to provide the Service, including sending them to our AI model providers. We do not sell your content.

7. Availability and changes

We aim for high availability but do not guarantee the Service will be uninterrupted or error-free. Tariff data changes frequently; we update it regularly but cannot guarantee it reflects every change at the moment you use it. We may modify or discontinue features with reasonable notice.

8. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR DUTIES, PENALTIES, LOST PROFITS OR LOST DATA. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.

10. Termination

You may delete your account at any time from the account page. We may suspend or terminate accounts that violate these Terms. Sections 2, 6, 8, 9 and 11 survive termination.

11. Governing law

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Delaware.
